Customer Terms & Conditions

This Agreement, entered upon the date of order placement is made by and between FarmDeliver LLC (“Farm Deliver”) and the FarmDeliver customer (“CUSTOMER”). FarmDeliver and Customer may be referred to collectively as “parties.”

By using the website and any services provided, Customer agrees to adhere to the terms and conditions set forth. Customer has a limited right to use the FarmDeliver website and services as long as they abide by the terms that are set forth herein.

WHEREAS, FarmDeliver desires to facilitate and deliver customer orders, and Customer desires to pay FarmDeliver to facilitate and deliver their orders, on the terms and conditions set forth herein.

NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, the receipt and sufficiency of which is acknowledged by the parties, the parties agree as follows:

1. Customer must be 18 years of age to use the FarmDeliver website.

2. Customer is responsible for their order upon delivery, including, but not limited to, placing a cooler outside their door to collect their order if they are not at home.

3. It is the customer’s responsibility to cancel a delivery by the deadline.

4. Customer assumes responsibility for anything that may happen to products after delivery, including damage to quality as a result of being left outside.

5. Customer will not hold FarmDeliver or associated third parties responsible for anything that may happen to products after delivery. Associated third-parties include but are not limited to delivery drivers and partnering farms.

6. By purchasing a CSA, customer understands that the CSA is a non-refundable purchase, and that the purpose of the CSA is to allow the customer to share in the financial risk of farming. Therefore, in the event that the CSA shares cannot be fulfilled, neither the farm, nor FarmDeliver are responsible for refunding any portion of the CSA purchase, except for the delivery fee and associated tips for weeks when Customer does not receive a scheduled delivery of any kind from FarmDeliver.

7. Customer is responsible for ensuring all data provided is accurate and true and for maintaining account information, including their password.

8. Prohibited uses of the FarmDeliver website and services including any illegal purposes, harvesting data, or harassing others.

9. FarmDeliver owns all intellectual property rights to content on the website, except for any user content, and Customers may not use it in any way without permission.

10. FarmDeliver will not sell, rent or share customer information except with partners enlisted to fulfill and deliver Customer orders.

11. In the event that a product is lost or damaged during delivery, FarmDeliver or the culpable third party will refund or replace the lost or damaged product.

12. FarmDeliver is not responsible for compensating the customer, farmer, or other parties for unsatisfactory products.

13. Customer is aware and understands that food products may contain certain harmful foodborne contagions and that, by ingesting food products delivered through FarmDeliver, customer agrees and assume any and all risks of injury, disability, and death arising from ingesting such food products. FarmDeliver warrants to Customer that the product shall be promptly delivered and that the temperature of such product shall comport with basic food safety guidelines. EXCEPT FOR THIS LIMITED WARRANTY, FARMDELIVER MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCT, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.
